Workers’ Compensation
Hurt on the Job?
Today’s fast past consumer demands fast pace work. This type of demand frequently results in accidents and mishaps at work, often resulting in injury or illness. If you have been the victim of a Pennsylvania workplace accident or illness, you could be eligible for Workers’ Compensation benefits. Continue reading for more information on whether you may be eligible!
Workers’ Compensation Insurance, or “Workers’ Comp” as its often referred to as, offers a sense of stability to many of America’s hardest working men and women, particularly in the most chaotic times of their lives. Nobody wants to get hurt at work, but accidents and mishaps happen. If you have been hurt at work, or contracted a serious illness at work, it’s vital you contact an attorney immediately. Each state has different statutes that govern how the Workers’ Compensation process works in that state, so it is important that you ensure your legal representation is well versed in your state’s Workers’ Compensation process. The three steps every hurt or sick worker must do after their injury/illness occurs are as follows:
- Report your injury or illness to your supervisor. (Some companies may have you fill out an incident report)
- Call an attorney
- Make sure you are treating with a company approved medical professional for the first 90 days.
In order to receive Workers’ Compensation, an individual must have a direct employment relationship, and have gotten hurt or sick while within the scope of his/her work. In other words, if you are an employee of a company, and you were injured or became ill due to your work in Pennsylvania, you are eligible for Pennsylvania Workers’ Compensation benefits. If you are working as an independent contractor, you may also be able to receive benefits if you can prove that you should be classified as an employee.
Nothing else matters! It doesn’t matter if you made a mistake, or broke a company rule, or anything. You are covered by the no-fault system. In some rare and unique circumstances, you can even be hurt on a job outside the state of Pennsylvania and still receive Pennsylvania Workers’ Compensation benefits due to “Extraterritorial Jurisdiction.” The Pennsylvania Workers’ Compensation system is very worker-friendly, but it can be overwhelming and intimidating, especially if you feel like you’re fighting for yourself, by yourself.
Due to the emergence of the COVID19 pandemic worldwide, many states, including Pennsylvania, have now offered Workers’ Comp to employees who contract COVID19 at work. For many middle aged and older Americans, COVID19 can present complications and lasting effects, even after the original symptoms disappear. If you have dealt with any health complications due to COVID19, and feel strongly that you contracted it at work, please contact an attorney immediately.
